Tensions inside the courtroom reached an absolute breaking point as defense counsel engaged in a fierce, high-stakes battle with the investigating officer during a critical bail hearing.

The courtroom atmosphere grew increasingly hostile as the defense attempted to dismantle the prosecution’s heavy case by systematically challenging the state’s evidence on record.

State prosecutors immediately raised strong objections, arguing that the investigating officer was being improperly subjected to cross-examination on witness statements contained within the police docket.

The state maintained that the investigating officer was not the author of those specific witness statements and had merely gathered the evidence to demonstrate the strength of the state’s case.

Defense counsel forcefully pushed back against the state’s objections, insisting on the absolute right to test the allegations placed before the court to determine whether the matter truly falls under a Schedule 6 offense.

“She’s not the author of the evidence. She’s the gatherer of the evidence and the court must just accept it without it being tested. That is never the purpose of a bail application”, defense counsel asserted directly to the presiding officer.

The intense legal sparring quickly centered on paragraph 10 of page six of the state’s affidavit, which details the alleged involvement of Shadrach Sibia in human trafficking charges.

Under direct questioning, the investigating officer confirmed that Mr. M drove his own GWM bakkie together with Shadrach Sibia to fetch four young women from the hotel.

The investigating officer clarified to the court that Mr. M acted on the instructions of Shadrach Sibia because Mr. M was employed by him at the time of the incident.

Court testimony revealed that on Friday, 15 May 2026, four young women requested transport assistance from Mr. M for a planned outing.

The investigating officer explained that ZM, the daughter of Mr. M, was originally scheduled to participate in the trip because she was friends with one of the girls, but she Ultimately did not attend.

Mr. M picked up the four women from the Gautrain station in his vehicle and transported them to the Sandton Garden Court hotel.

Mr. M utilized his personal hotel loyalty points to assist the young women in securing a discount on their accommodation fees before leaving them at the venue.

The following day, on Saturday, 16 May 2026, the young women initiated a WhatsApp group call with Mr. M to request transport to Sandton City mall to eat food and take photos.

The investigating officer testified under oath that Shadrach Sibia peeped through the mobile phone of Mr. M during the live video call and overheard the group’s plans.

Rather than allowing the group to proceed to the mall, Shadrach Sibia suggested that they take the young women to an establishment called the Grand, which functions as a strip club.

Shadrach Sibia claimed to Mr. M that the establishment was owned by his friend and served quality food.

Mr. M drove Shadrach Sibia directly to the hotel to collect the four young women.

Upon arrival at the hotel, Shadrach Sibia ordered the young women back to their hotel room to change their clothing, declaring that the venue was “classy”.

As the cross-examination intensified, defense counsel attempted to show that Shadrach Sibia had no direct involvement in securing, transporting, or paying for the young women’s initial hotel accommodation.

The state prosecutor interrupted the proceeding, expressing deep frustration over the repetitive nature of the questioning and questioning where the line of inquiry was leading.

“I’m finding it disturbing. It’s a repetition of summary of evidence that is not coming from the witness and on each and every sentence she’s taken to repeat the same”, the state prosecutor stated.

The state prosecutor demanded that the defense state plainly whether they were directly challenging the strength of the state’s human trafficking charges.

Defense counsel confirmed that the entire objective of the cross-examination was to demonstrate that the facts presented in the state’s affidavit do not satisfy the legal requirements of human trafficking.

With the hour approaching 17:00, the presiding officer stepped in to halt the intense proceedings and adjourn the court for the day.

The presiding officer formally postponed the bail hearing to the following morning at 08:00, ordering that Shadrach Sibia remain in custody pending further hearing.
