A tense courtroom scene unfolded in the magistrate’s court as high-ranking police official Lieutenant General Shadrack Sibiya stood before the bench in custody for his formal bail hearing.

Presiding Officer Mrs. Kasiyape opened the record on September 29, 2026, alongside prosecutor Advocate Masana for the state and lead defense counsel Advocate Killian.

Before the formal reading of the indictment, Advocate Masana addressed the court regarding the overwhelming presence of journalists and media cameras packing the gallery.

Advocate Masana requested an immediate reaffirmation of a prior judicial restriction banning media crews from broadcasting or showing the faces of the prosecution team, the lead investigating officer, and the presiding officer.

Mrs. Kasiyape strictly upheld the protective order, warning news organizations that no television coverage would be permitted to display the prosecution team or the judicial officer on air.

Following the media directive, Advocate Masana formally read the severe criminal indictment lodged against Lieutenant General Shadrack Sibiya, declaring that the entire proceeding falls under the strict legal threshold of Schedule Six.

Count one charges Lieutenant General Shadrack Sibiya with contravening section 18, subsection 1, paragraph A of the Sexual Offenses Act 32 of 2007 for promoting the sexual grooming of a child.

Count two charges him under section 18, subsection 2, paragraph A of the same act for the direct sexual grooming of a child.

Count three charges him under section 18, subsection 2, paragraph D of Act 32 of 2007 for an additional offense of sexual grooming of a child.

Count four charges Lieutenant General Shadrack Sibiya with contravening section 4, subsection 1 of the Prevention and Combating of Trafficking in Persons Act 7 of 2013 for human trafficking.

Count five charges him under section 3 of Act 32 of 2007 for the crime of rape.

Addressing the bench, Advocate Masana moved an urgent application under section 86, subsection 1 of the Criminal Procedure Act to correct a critical clerical error on the second page of the charge sheet annexure.

Advocate Masana demonstrated that the indictment erroneously listed a key offense date as July 16, whereas the underlying factual preamble, count four, and count five explicitly establish the actual date of the offense as May 16.

Defense counsel Advocate Killian, appearing alongside Advocate Nell, Advocate Maka, and instructing attorney St. Dolly, confirmed that the defense had no objection to the state’s date correction.

Mrs. Kasiyape officially granted the state’s application, amending the charge sheet on the record to reflect the May 16 date.

Taking the floor to launch the defense case under Schedule Six standards, Advocate Killian formally declared that Lieutenant General Shadrack Sibiya has no previous criminal convictions.

Advocate Killian emphasized that the prosecution confirmed the absence of prior convictions, while explicitly noting that the defense is aware of a separate ongoing investigation that does not constitute a pending criminal case.

Advocate Killian handed the original, signed bail affidavit deposed by Lieutenant General Shadrack Sibiya directly to Mrs. Kasiyape, supplying an official copy to the state as oral and written arguments commenced.
