MADLANGA COMMISSION | R2.29M PAID! CHASKALSON UNPACKS “PROTECTION FEE” CLAIMS
High Court Dismisses Urgent Review as Commission Unseals Explosive Extortion Dockets Implicating Underworld Figures in Multi-Million Rand Protection Racket

A dramatic legal showdown unfolded before the commission as evidence leaders announced that the Johannesburg High Court officially dismissed Mr. Sindane’s emergency review application earlier in the morning, complete with a punitive costs order.
Mr. Chaskalson opened the proceedings by confirming that Mr. Sindane had spent the previous week filing urgent legal challenges designed to immunize himself from the commission, culminating in a Saturday high court filing aimed at setting aside the commission’s prior refusal to grant a postponement.
Following the dismissal of the urgent high court review with punitive costs, legal representatives for Mr. Sindane contacted the commission’s attorneys requesting yet another postponement for the day’s proceedings.
Evidence leaders conveyed a firm ultimatum: the state intended to proceed with flighting documentary evidence concerning Mr. Sindane at 11:30 AM, instructing his legal team to be present to argue any formal postponement application by that hour.
When counsel failed to arrive by 11:30 AM due to traveling from Johannesburg, a formal written postponement application arrived via email at 11:29 AM, indicating that legal teams would reach the venue by 12:00 PM.
Noting that the defense had enjoyed since Friday morning to prepare a postponement motion, the evidence leaders rejected further tactical delays, declaring that the commission had danced around Mr. Sindane for far too long.
Justice Madlanga authorized the commission to proceed immediately with the presentation of evidence, noting that the tribunal would evaluate any arguments presented by defense counsel upon their arrival at midday.
Mr. Chaskalson took the floor to present an explosive body of evidence drawn directly from the criminal docket and encrypted WhatsApp extractions from Mr. Sindane’s personal cellular device.
The primary foundation of the state’s presentation centered on the sworn statement and docket affidavits of Dr. Babuni Ntuli, director of the mining firm Tangani Mining, found at page 475 of the official bundle.
Dr. Babuni Ntuli detailed a sophisticated, long-running extortion racket enforced through direct threats of violence and operational shutdowns.
The testimony established that Tangani Mining secured a mining rights permit on December 15, 2022, covering a farm in Kaffafontein within the magisterial district of Marble Hall, with the objective of supplying aggregate stone to King Civil, the main contractor appointed by Sanral for the construction of the Moloto Road.
Upon approaching King Civil, Dr. Babuni Ntuli was instructed to engage with community liaison officer Mr. Caesar, who referred him to local business forum chairperson Vusi Masela.
Vusi Masela subsequently directed Dr. Babuni Ntuli to Joe Sibanyoni, explicitly introduced to him as “the president”.
Dr. Babuni Ntuli attended a high-level meeting at the Centurion Golf Estate in Pretoria, where he met Joe Sibanyoni, Vusi Masela, Mr. Caesar, and a man introduced as Bafana Kabini, identified through docket chats and phone numbers as Mr. Sindane, who was formally introduced as the deputy president.
At this initial meeting, Joe Sibanyoni informed Dr. Babuni Ntuli that he was required to pay an upfront cash sum of 100,000 Rand simply to “open a channel of communication”.
Dr. Babuni Ntuli delivered the 100,000 Rand cash payment directly to Joe Sibanyoni the following day.
During subsequent meetings on November 4, 2022, Joe Sibanyoni and Mr. Sindane demanded a staggering 40 percent cut of all earnings generated from the Moloto Road aggregate supply contract.
When Dr. Babuni Ntuli protested that such a cut was entirely unaffordable, the extortionists reduced the demand to a fixed monthly protection fee of 100,000 Rand, instructing him to deposit the funds directly into the bank account of MJ and Sons Transport, a corporate entity owned by Joe Sibanyoni.
The bundle introduced a comprehensive financial table at page 477 documenting a continuous series of cash deposits and bank transfers made into MJ and Sons Transport, totaling over 2.29 million Rand.
Whenever protection payments lagged, Dr. Babuni Ntuli received threatening messages from Mr. Sindane’s phone number, complaints signed under the chilling pseudonym “the landlord growth point” designed to disguise the true extortionist operation.
When Edwin Construction subsequently took over the Moloto Road main contract, the protection demands escalated; Joe Sibanyoni, Mr. Sindane, Vusi Masela, Mr. Caesar, and an operative named Goba demanded an additional levy of 15 Rand per ton of material delivered, issuing a punitive invoice for 286,000 Rand.
When Dr. Babuni Ntuli refused to capitulate and reported the extortion to police, Vusi Masela and his team launched a campaign of intimidation.
On November 14, 2025, Vusi Masela met with Edwin Construction representative Steve Montali, threatening to violently shut down all mining and trucking operations if Tangani Mining failed to yield.
Dr. Babuni Ntuli received a direct phone call from Vusi Masela on November 14, 2025, warning that all trucks on site would be physically blocked from operating on November 17, 2025.
Dr. Babuni Ntuli documented a separate intimidation tactic in his affidavit, revealing that Joe Sibanyoni forcibly imposed a private security company onto the mining site after Dr. Babuni Ntuli’s own security guards were severely beaten, bound with cable ties, and the weighbridge cables were deliberately severed to crush resistance.
The commission examined corroborating WhatsApp extractions from Dr. Babuni Ntuli’s phone starting at page 345, capturing extensive negotiations with Mr. Sindane—saved under the contact name “Bafanas”—regarding meetings at the Centurion Golf Estate to finalize extortion procedures.
As the state continued flighting the classified docket records and encrypted text archives, the commission awaited the delayed arrival of defense counsel at midday.
