A harrowing courtroom disclosure laid bare a chilling sequence of constitutional violations and physical brutality inflicted inside a private residence.

Under direct examination, the witness confirmed that neither Captain Forbella nor any accompanying law enforcement officer ever explained basic legal rights guaranteed under the Constitution of South Africa.

No permission was ever requested to open or enter the private premises, and no consent was granted by the occupant at any point during the operation.

The ordeal began when Captain Forbella instructed another officer to collect keys and directed members of the team to open the perimeter gate manually.

Once the gate was forced open, a large contingent of police officers swarmed the yard before moving to the rear of the property.

Officers immediately initiated unauthorized searches of multiple vehicles parked on the grounds, starting with Captain Forbella searching an i20.

Additional officers proceeded to search a Corolla and a Fortuner without asking for permission or explaining any constitutional rights to the property owner.

When a police officer holding the house keys arrived at the kitchen entrance, the primary door was already open while the security burglar gate remained locked.

The officer unlocked the burglar gate to grant the squad full entry into the home, again failing to request permission or issue a legal warning.

Upon crossing the threshold, Captain Forbella took lead control and forcibly navigated the occupant straight into a bedroom while other officers dispersed throughout the residence.

Inside the bedroom, Captain Forbella forced the individual to kneel on the floor and demanded the immediate surrender of hidden firearms.

When the occupant denied having any knowledge of weapons, Captain Forbella grabbed a duvet off the bed and threw it over the victim’s head.

“I must give him the firearms or he will blow my head up”, the witness testified, recounting the explicit threat made by Captain Forbella to fire a bullet directly into the victim’s skull.

Covered beneath the fabric and expecting imminent execution, the victim remained silent and silently recited a final prayer, believing life was coming to an absolute end.

While still pinned to the kneeled position, the victim suffered a violent physical assault to the right side of the back from a second officer present inside the room.

The two officers then yanked the victim off the floor and dragged the fully covered individual out of the bedroom and into the central lounge.

Inside the lounge, the relentless physical attack escalated as officers repeatedly punched the victim across the entire body while demanding the hidden weapons.

Captain Forbella ripped the duvet off, threw it onto the floor, and shouted: “I must give him the firearms that I used to kill the white person”.

When the victim again denied knowing anything about the murder weapon, Captain Forbella declared that he would force a confession, pulling the leather belt directly from the victim’s trousers.

Surrounded by multiple officers, the victim was forced onto the floor face-down on the stomach, with hands already handcuffed behind the back.

Captain Forbella used the victim’s own belt to tightly bind the wrists and ankles together behind the back.

With the victim completely immobilized, Captain Forbella called out “Time” to another officer, named Time, who stepped forward holding a heavy plastic Courier Guy bag.

Captain Forbella drove his knee deeply into the victim’s back, pinning the body to the floor, and pulled the plastic Courier Guy bag over the victim’s head.

Captain Forbella pulled the opening of the plastic bag tightly against the back of the neck to completely seal off the oxygen supply.

This brutal plastic bag suffocation tactic was repeated three to four separate times as officers shouted demands for a confession.

On the fourth cycle of suffocation, the total deprivation of oxygen caused the victim to lose consciousness completely on the floor.

Upon regaining consciousness, the victim began desperately agreeing to every statement and allegation thrown out by Captain Forbella.

Infuriated by the responses, Captain Forbella accused the victim of making him look stupid and forced the plastic Courier Guy bag over the victim’s head for a fifth time.

Unable to breathe, the victim suffered severe bodily spasms and kicked out violently in a desperate struggle for survival.

The extreme force of the victim’s kicking caused the leather belt binding the limbs to snap abruptly.

As the restraint broke, the victim suffered violent coughing fits and immediately began coughing up pools of fresh blood onto the floor.
