Adv Adila Hassim Expose Doctor, General Khan & his Son on alleged Fraudulent Certificate
A explosive legal showdown over secrecy, medical integrity, and missing testimony erupted inside the commission hearings as legal representatives battled over suspended Major General Khan.

At the heart of the fierce debate was a desperate bid by Major General Khan to secure a blanket confidentiality order, attempting to shield his clinical records and medical condition entirely from the public eye.
Counsel representing the commission evidence leaders hit back forcefully, arguing that accountability must prevail in the face of such severe allegations.
The evidence leaders made it clear that while they do not seek the public disclosure of every minute detail within his clinical record, they are actively resisting blanket secrecy over the medical condition of Major General Khan, his functional impairment, his prognosis, and his resulting ability to comply with official notices and subpoenas.
The confrontation deepened as the commission turned its focus toward a long-outstanding formal statement from Major General Khan that remains missing despite months of repeated demands.
Evidence leaders revealed a detailed chronology showing that the original Regulation 106 notice ordering Major General Khan to submit his statement was issued on 5 June 2026, with an initial deadline set for 22 June 2026.
Following that missed deadline, evidence leaders repeatedly pursued the document, formally chasing the statement on at least six separate occasions, several of which occurred before Major General Khan was shot on 28 June 2026.
Legal counsel for Major General Khan, Advocate Valley, provided explicit assurances and undertakings on at least three distinct occasions promising that the document would be delivered.
Advocate Valley first promised to submit the statement by 24 June 2026, a request accommodated by evidence leaders, only to claim on the deadline date that the document would be filed prior to 1 July 2026.
Later, on 21 August 2026, Advocate Valley again promised that the statement would be submitted during the week of 24 August 2026, yet no document was ever delivered.
Evidence leaders pointed out that the statement was already overdue prior to the shooting incident of 28 June 2026, completely undermining claims that the ongoing failure to submit the document was caused by the health consequences of the shooting.
The commission then addressed the critical demand for an independent medical evaluation to verify whether Major General Khan is truly unfit to appear before the inquiry.
The evidence leaders warned against falling into a trap of allowing Major General Khan to merely engage through his current treating doctor, insisting that an independent evaluation of the patient himself is essential, especially with time running short as the calendar reached 1 September 2026 with only weeks of hearings remaining.
The commissioners reinforced this stance, clarifying that an independent examination is simply a second opinion to assist the panel, as the commission is currently being held to ransom by a doctor chosen exclusively by a witness seeking an indulgence.
The panel expressed total disbelief at arguments claiming an independent evaluation would aggravate the health of Major General Khan, stating that such claims effectively tell the commission to stay out of the matter until April 2027.
The tension in the hearing room reached its peak when evidence leaders presented damning proof of altered and backdated medical documents involving Major General Khan and his psychiatrist, Dr. Fine.
Referencing public Labour Court records and an affidavit from Divisional Commissioner of Crime Intelligence Lieutenant General Khumalo, evidence leaders exposed how Major General Khan originally submitted a sick note dated 22 May 2026 from Dr. Fine, which booked him off sick until 30 June 2026.
However, on 20 August 2026, a second medical certificate was provided by Dr. Fine, carrying the same origin date of 22 May 2026, but suddenly altering the unfit-for-duty end date from 30 June 2026 to 27 June 2026.
Evidence leaders read into the record Lieutenant General Khumalo‘s sworn assessment that this date change was necessitated by the fact that Major General Khan was shot on 28 June 2026, a date that originally fell within his official sick leave period.
The changed date was specifically designed to avoid embarrassing questions regarding why Major General Khan was out on the street late at night while officially booked off sick.
A sworn affidavit from Dr. Fine himself was then read into the record, revealing the extraordinary sequence of events that led to the falsified documents.
Dr. Fine testified under oath that on 20 August 2026, an appointment was made by a man claiming to be the son of Major General Khan, who arrived at the medical practice demanding adjustments to the sick notes.
According to Dr. Fine, the son claimed that minor bureaucratic adjustments were needed regarding the dates and requested a complete rewrite of two certificates.
Dr. Fine explicitly asked the son if the original sick notes had already been submitted to Major General Khan‘s employer, warning him that modifying documents already submitted to work might constitute fraud.
The son of Major General Khan then left the consultation room to call his father, returning shortly after to falsely inform Dr. Fine that no sick notes had ever been submitted to the police.
Relying on that lie, Dr. Fine proceeded to rewrite and backdate the certificates, altering the end date to 27 June 2026 and adding a diagnosis of extreme stress, depression, and anxiety.
Dr. Fine admitted in his affidavit that at the time he made the adjustments, he was completely unaware of the true significance of the 28 June 2026 shooting date.
Evidence leaders completely shattered attempts by Advocate Valley to dismiss the incident as a routine response to South African Police Service administrative queries, pointing out that police requests for diagnosis details never asked for dates to be altered.
The commission concluded the heated session by pushing for a binding ruling modeled after the precedent set in the Mr. Karim matter, ordering an immediate independent medical evaluation by a nominated practitioner to determine once and for all if Major General Khan can face the panel.
